OVERVIEW: Crewfare® (“Sponsor” or “Crewfare”)) is on the quest for a spirited Explorer, someone who thrives on adventure and embodies our passion for the crew! This isn’t just any journey—it’s your golden ticket to becoming Crewfare’s first-ever Explorer, championing our innovative AI event marketplace that expertly matches enthusiasts with the perfect events.
Picture this: a year-long escapade to the most buzzworthy events within the United States of America. Rock out at legendary music festivals like Lollapalooza® and Austin City Limits Music Festival®, indulge in gourmet delights at renowned food festivals in South Beach and NYC, and share laughs at the Great Outdoors Comedy Festival.
By entering the Crewfare Explorer Contest, you (the “Applicant”) are applying to receive an offer to enter into an Independent Contractor Agreement with Sponsor. The Independent Contractor Agreement confers Explorer Perks, as set forth in Section 8 herein. Receipt of the Explorer Perks is wholly subject to Applicant’s acceptance of the Independent Contractor Agreement and compliance with all terms, conditions, duties and obligations contained therein.
Read these Rules carefully. They constitute a legally binding agreement by and between Sponsor and the Applicant and govern the Application process in this Contest. By participating, Applicants fully and unconditionally agree to abide by these Rules.
First, enter your name and email address and phone number through the submission form on Crewfare’s Explorer campaign landing page (“Submission Form”) at https://crewfare.com/explorer-wanted (“Contest Website”). You will also have an opportunity to submit your TikTok and Instagram handles, if any, and to list the number of followers you have on each platform.
Upon entering, each eligible Applicant will receive an email containing a link to submit a video showcasing the Applicant’s enthusiasm and unique take on adventure (“Video”). You will also have an opportunity here to enter additional information that you would like Sponsor to consider in evaluating your Application. Three (3) Videos will be selected based on a holistic review of the Application, including assessment of the Applicant’s creator potential, event travel insights conveyed in the Video, video editing skills, creativity, energy, and exhibiting Crewfare community values and deemed finalists (“Finalists”), subject to eligibility verification. The three (3) Finalists’ Videos will be posted on @Crewfare’s Instagram page (https://www.instagram.com/crewfare/) for public vote over a 24-hour period. The Finalist whose Video receives the most likes will win the opportunity to be Crewfare’s event explorer for a year (“Crewfare Explorer Opportunity”).
Submission Form entries must be received between July 15, 2024 at 9:00:01 am ET and July 23, 2024 at 7:59:59 am ET] (“Submission Form Application Period”). Video submissions must be received between July 8, 2024 at 9:00:01 am ET and July 23, 2024 at 8:59:59 am ET. Voting will take place on July 25, 2024 from 11:00:01 am ET to July 26, 2024 at 10:59:59 am ET (“Voting Period”).

- SPONSOR AND ADMINISTRATOR: The sponsor and administrator of the “Crewfare Explorer Contest” (“Contest”) is Crewfare, Inc, 2678 Edgewater Court, Weston, FL 33332. This Contest is in no way sponsored or administered by Festival or Brand Entities (defined in Section 6 herein). All inquiries regarding the Contest should be directed to Sponsor.
- BINDING AGREEMENT: These Official Rules (“Rules”) constitute a legally binding agreement by and between Sponsor and Applicant and govern Application in the Contest. By participating, Applicants fully and unconditionally agree to abide by these Rules.
- ELIGIBILITY: The Contest is open only to legal residents of the 50 United States and the District of Columbia who are 21 years of age or older at the time of Application, possess a valid social security number, and possess a U.S. Passport that is valid through September 30, 2024. Winner and winner’s guest must have a valid state-issued driver’s license or Real ID-compliant license or ID for identification purposes. Employees of Sponsor, United Airlines, Vacation® Sunscreen, California Pak LLC, 4AM Skin, Misfits Health, C3 Presents, LLC, any organizations responsible for fulfilling, administering, judging, advertising or promoting the Contest, the Crewfare Explorer Opportunity or Explorer Perks, C3 Presents, LLC, persons involved in the production (including hosts and crew) of Lollapalooza®, Austin City Limits Music Festival®, LA Auto Show, the Great Outdoors Comedy Festival, the South Beach Wine & Food Festival®, the NYC Wine & Food Festival, and/or each of their respective parent, subsidiary, affiliated and successor companies, and the immediate family members and household members of such individuals, are not eligible to participate. “Immediate family members” shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses, regardless of where they live. “Household members” shall mean people who share the same residence at least three (3) months a year, whether related or not. Void where prohibited or restricted by law.
Winner Eligibility: The Contest winner (“Winner”) must meet all of the terms and conditions in these Rules and Sponsor’s requirements, as detailed below in Sections 4 through 8.
If the Winner does not follow these Rules and meet Sponsor’s requirements, such Winner will be disqualified. In the event of the disqualification of a Winner, Sponsor shall not have any liability or obligation to such disqualified individual, and a replacement Winner will be selected based on the process as set forth herein, time permitting.
- CONTEST APPLICATION: All Submission Form entries must be received by July 23, 2024 at 7:59:59 am ET (the end of the Submission Form Application Period). All Videos must be received by July 23, 2024 8:59:59 am ET (the end of the Video Submission Period). Sponsor’s computer is the official clock for the Contest. To enter, go to the official Contest Website at https://crewfare.com/explorer-wanted.
Your Submission Form:
Step 1 (Submission Form): Complete the Contest Submission Form on the Crewfare Contest Website. You will be asked to provide your first name, last name, e-mail address, and phone number, and you will have an opportunity to submit your TikTok and Instagram handles, if any, and to list the number of followers you have on each platform (collectively, the “Application Information”) You will also be asked to check a box attesting that you meet the Contest’s eligibility requirements, and that you have read and agree to these Rules. When entering the Contest, you will have the option to agree to receive emails from Crewfare and its prize providers, subject to Crewfare’s Privacy Policy (https://crewfare.com/privacy)
Your Video
Step 2 (Submission of Video): After completing and submitting the Submission Form, an Applicant will receive an email containing a link to upload a Video up to two (2) minutes in length from your phone, computer or other applicable electronic device. The Applicant will also have an opportunity here to enter additional information that Applicant would like Sponsor to consider in evaluating the Application. This may include information about the Applicant’s unique life experiences or perspectives, about the events depicted in the Video, or any other information applicant would like Sponsor to consider in evaluating the Application.
The Applicant must appear in the Video. Video submissions should be from Applicant’s favorite sporting event, music festival, comedy festival or other live event. It can be a vlog, mashup, or something creative. It should showcase Applicant’s travel insights, video editing skills, creativity and energy. The goal is to demonstrate to Sponsor Applicant’s personality, passion for concerts, live events, entrepreneurial flair and/or creativity, and convey why Applicant would be a suitable candidate for the Crewfare Explorer Opportunity with Sponsor. The Video should be well thought-out and show why Applicant would be a positive addition to the Crewfare community.

VIDEO MAY NOT INCLUDE PERSONS UNDER THE AGE OF 18
Each Applicant must submit an original Video (DO NOT COPY OTHERS’ WORKS, IN WHOLE OR IN PART). If any other persons appear in or were involved in the creation of your Video (including without limitation person(s) who appear in a Video and/or if anyone was involved in shooting the Video), you agree that prior to submitting your Video, you have obtained the written consent of each such person, granting Sponsor and its designees the use of each person’s name, biographical information, image and/or likeness for advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet (including without limitation, for posting on the Contest Website in connection with the Contest), and in perpetuity by Sponsor and its designees, without compensation (except to the extent prohibited by law) or additional consents and without prior notice, approval or inspection, and to execute specific written consent to such use if asked to do so. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from you at any time. Failure to provide such proof, if requested, may result in your disqualification, at Sponsor’s sole discretion. If the Video includes other persons, those persons must not be under the age of 18, and Sponsor reserves the right to disqualify Applicant’s entire Application if Applicant has not obtained the written consent of each person included in the Video prior to submission. For the avoidance of doubt, permissions are not required in instances where images of crowds of people or unidentifiable people in the background in a Video may appear. Do NOT include personal information (e.g., your address, e-mail address or phone number) in the Video itself as the Video may be posted in conjunction with your participation in the Contest as detailed below. In addition, the Application must be truthful.
Video file attachment must not run more than two (2) minutes in total length and may be recorded on a smart phone, camera or any other recording device, in one of the following major video formats: MP4 and MOV. In submitting your Video, include your first and last name and email address (make sure your name and email address match the name and email address on your Submission Form), event name and any other information that you want the Sponsor to know (up to a limit of 400 characters). All Video Entries must be received by 8:59:59 am ET on July 23, 2024.
Partial or incomplete/piecemeal submissions, submissions without a Video, submissions with music, or Video submissions longer than two (2) minutes in length will NOT be accepted. Should a prospective Applicant’s Video not meet one or more of the criteria above, Sponsor reserves the right, in its sole discretion, to contact such prospective Applicant and allow him/her to resubmit his/her Video and thereby enter the Contest. For the avoidance of doubt, nothing in any way obligates Sponsor to extend the opportunity to a prospective Applicant to resubmit his/her Video; and, Sponsor will not incur any liability under any legal theory for not extending such opportunity to a given prospective Applicant for any reason. Further, resubmission of a Video does not mean that such Video will receive any different treatment and does not improve your chances of winning. If an Applicant is allowed to resubmit his/her Video, such Video will then continue through the Contest process as described below. Sponsor will not incur any liability under any legal theory if such resubmitted Video is not selected to become a Finalist.
The Video submission and any additional information provided by Applicant when submitting the Video are the “Video Submission Information.” An “Application” consists of an individual’s Application Information and Video Submission Information.
Limit one (1) Application per person during the APPLICATION Period. Multiple entries in excess of this limitation or mass Application attempts will result in disqualification of all entries by such person. Entries must be manually key-stroked; use of automated entry devices or programs is prohibited. Once submitted, an Application cannot be modified by Applicant, and will not be returned. Personal information collected in connection with this Contest will be treated in accordance with Sponsor’s privacy policy, available at: https://crewfare.com/privacy.
During the Application process, you will be asked to consent to receive emails and Contest reminders from Sponsor. Consenting to receive these emails is optional and does not have to be agreed upon in order to be eligible to participate in the Contest and does not improve your chances of winning. In the event you do consent to receive these emails, the use of such emails shall be subject to Sponsor’s privacy policy, and you may opt out of receiving these emails at any time. Notwithstanding the foregoing, Sponsor will use email to notify Applicants if they have been deemed Finalists or the Winner as described below.
JUDGING: Following the close of the Video Submission Period, a panel consisting of Sponsor’s Director of Marketing and three Crewfare founders (“Judges”) will review the Videos. Three (3) Finalists will be selected based on a holistic assessment of the following criteria: travel insights, video editing skills, creativity, vibrancy, charisma, enthusiasm, alignment with Crewfare’s brand, relevancy of content to Crewfare’s target audience, Applicant’s ability to convey their personality through creative content, and demonstrated potential to build followers and create compelling social media content. Crewfare’s brand aligns with passion for adventure, vibrancy, charisma, and enthusiasm for bringing people together. Its target audience consists of adventurous travelers who seek to make every journey unforgettable.
All aspects of an Application will be considered in the judging process, including Application Information and Video Submission Information. In the judging process, an Applicant’s existing social media content may be reviewed, and points may be deducted if this content contains evidence of hate speech, inflammatory remarks, excessive alcohol use, drug use, presence of criminal activity, public affiliation with hate groups, or excessive political rhetoric.
Applicants who make contact with any Judges to discuss their Video or the Contest will be automatically disqualified.
The Judges will score each Application on a scale of 1-100, based upon their holistic consideration of all criteria set forth above. When the total scores are tabulated by the Judges, the top three (3) Videos will advance to become the Finalists. The scoring sheets containing the Judges’ scoring will not be made public and will not be shared with Applicants. Applicants waive any and all rights they may have to review the scoring sheets. In the event of a tie, the Applicant with the higher Crewfare brand values score will be considered the winner of the tie. The Videos of the Finalists, subject to verification of eligibility and compliance with these Rules, will proceed to the Voting Period. Each potential Finalist will be notified. Failure to respond to the initial verification email within 12 hours of notification, or return of the email as undeliverable, may result in disqualification. Only one email will be sent. Applicants should check their Spam and Junk folders for Sponsor emails. If a potential Finalist is disqualified for any reason, an alternate Finalist will be selected (time permitting), i.e., the Video that received the next highest Judges’ score.
Within twenty-four hours of notification, potential Finalists will be required to (i) sign and return a provisional Independent Contractor Agreement that will become effective if and only if the potential Finalist is declared the Contest Winner (ii) sign and return a Finalist Affidavit of Eligibility and Release, including releases of liability and indemnification, and release of publicity, where permitted by law, (iii) sign and return an IRS Form W-9 and (iv) provide proof that they possess a U.S. Passport valid through September 30, 2024. Finalists may also be required to obtain and return signed release(s) from person(s) who appear in the Video (if applicable) (collectively, “Application Documents”). If the Application Documents are not returned to Sponsor within the specified time period, the potential Finalist may be disqualified.
- ADDITIONAL APPLICATION RULES AND RESTRICTIONS: By submitting an Application, each Applicant grants Sponsor and its designees a perpetual, non-exclusive, irrevocable, fully-paid, royalty-free, sub-licensable and transferable (in whole or part) worldwide license to use, reproduce, edit, transmit, display, exhibit, distribute, create derivative works based upon, publicly perform and otherwise exploit the Video submission, in whole or in part, in all media formats and channels now known or hereafter devised (including without limitation, for use and display on the Contest Website and/or Sponsor’s social media accounts) for any and all purposes including entertainment, news, advertising, promotional, marketing, publicity, trade or commercial purposes, all without further notice to the Applicant, with or without attribution, and without the requirement of any permission from or payment to the Applicant or to any other person or entity. Finalists and the Winner may be required to sign a grant of rights and release conveying the above rights in order to be confirmed as a Finalist and Winner (as applicable).
Without limitation of Sponsor’s Terms and Conditions, by submitting an Application, each Applicant agrees to grant Sponsor and its designees the use of Applicant’s name, biographical information, photograph, image and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and its designees, without compensation (except to the extent prohibited by law) or additional consents and without prior notice, approval or inspection, and to execute specific written consent to such use if asked to do so.
Without limitation of Sponsor’s Terms and Conditions, Applicant further expressly acknowledges that Sponsor and any other entity affiliated with this Contest do not owe him/her a duty of confidence (or fiduciary duty or the like) with regard to his/her Video submission and that Sponsor has wide access to ideas, stories, photos, methods, designs and other literary/artistic materials submitted to them from outside sources or being developed by their own respective employees and that such ideas/stories/ methods/videos/designs/literary/artistic materials may be competitive with, similar to (or even identical to) the Video submission submitted by Applicant and that Sponsor shall have no liability to Applicant or any third party in conjunction therewith.
Without limitation of Sponsor’s Terms and Conditions, a Video submission may not contain, and Sponsor, in its sole discretion, may disqualify and/or remove any Video submission that contains any content that: (1) violates any law or regulation; (2) violates or infringes any right of any third party, including but not limited to intellectual property rights, such as but not limited to rights of copyright, trademark or patent, or rights of publicity or privacy; (3) is defamatory, slanderous, libelous, scandalous or obscene; (4) contains any third person’s personal information, such as personal names or email addresses; (5) contains any virus, bugs, or other deleterious material; (6) embodies the names or likenesses of any individuals other than Applicant. unless Applicant has first obtained the prior written consent of any named/depicted/described person as set forth herein; (7) is sexually explicit, pornographic or contains nudity; (8) is violent; (9) is derogatory of any ethnic, racial, gender, religious, professional, or age group; (10) is profane (11) promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); (12) promotes any activities that may appear illegal, unsafe or dangerous; (13) promotes any particular political agenda or message; (14) communicates messages or images inconsistent with the reputation, image and/or goodwill of the Sponsor or any other entity affiliated with this Contest; or (15) is otherwise offensive, inappropriate, objectionable, or unsuitable for the uses contemplated in these Rules, as determined by Sponsor in its sole discretion.
Sponsor and the other Released Parties (as defined below) will not be responsible or liable for any inability to view a Video submission or any part thereof due to any technical difficulty, malfunction or failure of any kind.
The Video submission must be the original work of the Applicant. By submitting a Video, Applicant further warrants and represents that he/she and any persons appearing or who are identifiable in the Video submission consent to the submission and use of the Video submission in the Contest and to use of the Video submission as otherwise set forth herein.
Eligible Videos received by Sponsor may be posted, in whole or in part, on the Contest Website and/or on Sponsor’s Instagram page for public viewing; such posting has no effect on the judging of Videos as set forth below, except as otherwise expressly indicated below. Applicants understand and agree that Videos may be formatted, edited or otherwise converted in order to be viewable on the Contest Website. Sponsor reserves the right to remove any Video from the Contest Website at any time and for any reason, without liability of any kind. Except as otherwise expressly indicated below, Sponsor may but is not obligated to post Videos on the Contest Website; if Sponsor chooses to do so, such posting is for entertainment purposes only and Applicant releases and agrees to hold harmless the Released Parties from any and all liability associated with possible posting (or, conversely, non-posting) of his/her Video on the Contest Website, including his/her express acknowledgment that (a) if posted, posting of the Video does not constitute any representation by Sponsor as to Contest eligibility (see also “Voting” below); (b) if posted, the Video as posted may differ from the Video submitted by Applicant, and may not be viewable at all times, due to technological limitations/malfunctions/errors or other causes; (c) Videos may be displayed on the Contest Website in any pattern, sequence or format, and such pattern/sequence/format may or may not be rotated or varied one or more times, in Sponsor’s sole discretion; (d) Video may or may not be attributed to Applicant [but, if so attributed, all aspects of the attribution (such as, prominence and placement) are at Sponsor’s sole discretion]. Once a Video is posted on the Contest Website, Sponsor is under no obligation to remove a Video for any reason. FOR ALL VIDEOS POSTED ON THE CONTEST WEBSITE, THE VIDEOS REPRESENT SOLELY THE VIEWS/OPINIONS OF THE INDIVIDUAL APPLICANT AND DO NOT REFLECT THE VIEWS/OPINIONS OF SPONSOR IN ANY MANNER. SPONSOR DISCLAIMS ANY AND ALL LIAIBLITY IN CONJUNCTION WITH POSTING OF VIDEOS. Without limitation of any other terms herein, by entering, Applicant agrees to indemnify and hold harmless Released Parties (as defined below) from any action or liability resulting from the possible publishing of his/her Video and/or the use of his/her Video.
- VOTING PERIOD: The Voting Period to determine the Winner will take place between July 25, 2024 at 11:00:01am ET to July 26, 2024 at 10:59:59 am ET and will take place on Sponsor’s Instagram page. Sponsor reserves the right, in its sole discretion, to modify the Voting Period, for any reason including but not limited to interruptions in Internet services and logistical reasons. Finalists may share the Crewfare Instagram post containing their Video on Instagram. [A] BE SURE TO SHARE THE LINK IN ACCORDANCE WITH THE TERMS/POLICIES OF INSTAGRAM; AND [B] WHEN SHARING, USE #CrewfareExplorerContest TO DISCLOSE THAT YOU ARE SHARING THE LINK IN CONJUNCTION WITH PARTICIPATION IN A CONTEST SPONSORED BY SPONSOR.
This Contest is in no way sponsored, endorsed or administered by, or associated with, Instagram. Applicant understands that you are providing your information to the Sponsor, and not to Instagram. By participating, you release and hold harmless Instagram and any of its affiliates or parent entities from any and all liability in conjunction with the Contest.
The public is invited to vote on the posted Videos during the Voting Period by “liking” the Sponsor Instagram post containing the Video that they want to vote for.
At the conclusion of the Voting Period, the Finalist whose Video received the most “likes” on Sponsor’s Instagram post will be declared the Winner. In the event of a tie among Finalists, a one-hour run-off Voting Period will be announced by Sponsor (“Run-off Voting Period”). The Finalist who receives the most “likes” in the Run-off Voting Period, will be declared the Winner. The Winner will be notified by email.
If an Applicant is determined by Sponsor to be involved in any action which in any way seeks to undermine the integrity or legitimacy of the voting, such Applicant will be disqualified with Sponsor reserving the right to pursue legal sanctions against such Applicant. By way of example only, prohibited conduct includes offering any monetary or non-monetary benefit or compensation to “like” (or not “like”) a Video, or encouraging voters to create multiple social media accounts in order to increase the number of times they can vote.
- CREWFARE EXPLORER OPPORTUNITY AND APPROXIMATE RETAIL VALUE (“ARV”): The Winner will receive the Crewfare Explorer Opportunity – an offer to enter into an Independent Contractor Agreement (“Agreement”) with Sponsor. The Agreement that will be offered to the Winner is available at: [link] . For Lollapalooza® and Austin City Limits Music Festival® (each a “Festival”) tickets prizing: Ticket delivery method is at sole discretion of C3 Presents, LLC, which will be either sent to winner by mail, email, mobile ticketing or placed at venue Will Call the day of Festival under the winner’s name. Winner must be present to pick up tickets and a valid photo ID will be required if tickets are placed at Will Call. Winner and guest must be at least twenty-one (21) years of age and must abide by all venue and Festival policies, to include but not limited to, showing a valid photo ID at venue for age verification and/or identification purposes. Festival Entities (as defined below) reserve the right to revoke full or partial prize from any winner or winner’s guest who it or venue personnel deem may, in its sole discretion, be intoxicated, be a safety risk, have violated any venue policy or law, or may bring Festival Entities into disrepute. Any unclaimed and/or unused tickets will remain the property of Festival Entities. Resale of tickets is prohibited. By claiming Festival tickets, you agree to Front Gate Tickets’ Terms of Use, and to abide by the health and safety measures in effect at the time of the event, which may include, without limitation, wearing masks, providing proof of vaccination status and/or providing proof of negative COVID-19 status. Tickets are non-transferable and may not be reissued once travel has commenced. Open tickets may not be issued and stopovers are not permitted.

ARV of the Explorer Perks, upon the Winner’s acceptance, execution and compliance with all terms and conditions of the Agreement is $$16,624 USD. If the Winner does not accept, execute and comply with all of the terms and conditions of the Agreement, he/she will not be eligible to receive any Explorer Perks or any other compensation, and an alternate Winner will be selected. The alternate Winner will be the Finalist whose Video submission has received the second-highest number of “likes” during the Voting Period. The alternate Winner will be notified by the email address the Applicant used to enter this Contest.
The Winner will not receive any cash or any other form of compensation if the actual value of Explorer Perks is less than the ARV in these Rules.
Upon the Winner’s acceptance, execution and compliance with all terms and conditions of the Agreement, the Winner will receive further instruction on how to receive Explorer Perks through email.
The Winner must be available to travel to and attend all listed events and will be required to participate in social media activities and content creation during their travels and attendance at the events as set forth in the Agreement. The Winner must also comply with all the rules of the events he or she is attending. The Crewfare Explorer Opportunity is NOT an offer of employment, nor does it constitute employment with Sponsor.
The Winner is not entitled to exchange or transfer any of the Explorer Perks or to obtain cash or other substitutes, except Sponsor reserves the right to substitute portions thereof of equal or greater value if any portion of the Explorer Perks is unavailable for any reason. All federal, state and/or local taxes are the sole responsibility of the Winner, who will receive a 1099 tax form reflecting actual value of any Explorer Perks valued at $600 or more. The Winner should consult his/her tax professional regarding any tax questions.
Should the Winner fail to adhere to any instructions of Sponsor or engage in unruly, obnoxious, illegal, threatening, or otherwise inappropriate behavior (as determined by Sponsor in its sole discretion), Sponsor reserves the right, without further notice or warning, to terminate Winner’s participation in the Contest without any liability or other obligation.
The Winner’s guest at any Explorer Perk Event must be at least 21 years of age and may be required to execute liability release forms from Brand Entities, Festival Entities, Event Entities (as these terms are defined below), and/or Sponsor prior to participating in any Explorer Perk Event.
- GENERAL CONDITIONS: Sponsor reserves the right in its sole discretion to disqualify any individual they find to be tampering with the Application process or the operation of the Contest or to be acting in violation of these Rules. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Rules shall not constitute a waiver of that provision. Sponsor and its designees are not responsible for failed, partial or garbled computer transmissions, or for technical failures of any kind, including but not limited to electronic malfunction or damage of any network, hardware or software. If for any reason the Contest (in whole or in part) is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm or other natural cataclysm, epidemic, riot, strike, civil commotion, governmental regulation or any other causes beyond Sponsor’s control that corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the Application process, and to terminate, modify or suspend the Contest. In such event, Sponsor reserves the right to conduct the Contest and select the Finalists and Winner in a manner which is fair, appropriate and consistent with these Rules, as determined by Sponsor in its sole discretion. Notice of termination/modification/suspension of Contest will be posted on the Contest Website. No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or loss, destruction or unauthorized access to, or alteration of, entries (including Videos); or any problems or technical malfunctions of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or electronic Application to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to Applicant’s or any other person’s computer or mobile device related to or resulting from participation in or downloading any materials from this Contest.
If you opt to participate via your wireless mobile device, data rates may apply to your use of your wireless device according to the terms and conditions of your service agreement with your wireless carrier. Other charges may apply (such as normal airtime and carrier charges as well as charges for wireless Internet access) and may appear on your mobile phone bill or be deducted from your prepaid account balance. Wireless carriers’ rate plans may vary, and you should contact your wireless carrier for more information on messaging rate plans and charges relating to your participation in this Contest. Mobile device service may not be available in all areas. Check your phone’s capabilities for specific instructions.
Applicants further agree not to knowingly damage or cause interruption of the Contest and/or prevent others from participating in the Promotion. CAUTION: ANY ATTEMPT TO DAMAGE ANY ONLINE SERVICE OR WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY APPLICANT MAKING SUCH ATTEMPT AND SEEK DAMAGES TO THE FULLEST EXTENT OF THE LAW.
- RELEASES AND LIMITATIONS OF LIABILITY. By entering the Contest, each Applicant agrees to forever and irrevocably release and hold harmless (i) Sponsor and its owners, parents, partners, divisions, subsidiaries, representatives, shareholders, officers, directors, members, managers, agents, employees, affiliates (whether direct or indirect), successors, and assigns (collectively “Sponsor Entities”), (ii) each of the Sponsor Entities’ affiliates, parent companies, subsidiaries, representatives, consultants, contractors, attorneys, suppliers, distributors, advertising/promotional agencies, business partners, public relations, fulfillment and marketing agencies, website providers and their respective officers, directors, stockholders, employees, agents, and representatives, (iii) United Airlines, Vacation® Sunscreen, California Pak LLC, 4AM Skin, Misfits Health (collectively “Brand Entities”), LA Auto Show, the Great Outdoors Comedy Festival, the South Beach Wine & Food Festival®, the NYC Wine & Food Festival (collectively “Event Entities”), and C3 Presents, LLC and its landlords or licensors (related to Lollapalooza® and Austin City Limits Music Festival®), if any, Capital of Texas Public Telecommunications Council, Inc., Austin Parks Foundation, the City of Austin, Caring & Daring, LLC, Lollapalooza, LLC, Chicago Park District, the City of Chicago, Live Nation Worldwide, Inc. (collectively “Festival Entities”), and each of their respective parents, partners, divisions, subsidiaries, shareholders, officers, directors, members, managers, agents, affiliates, volunteers, employees, and artists performing on a Festival and their respective employees and (iv) any and all social media platforms on which the Contest is marketed or promoted, including but not limited to Facebook, Instagram and/or Twitter (collectively, “Social Media Platforms”), the Social Media Platform’s respective officers, directors, employees, agents, representatives, successors and assigns (all of the foregoing collectively, the “Released Parties”) from any and all claims, lawsuits, judgments, causes of action, injuries, losses, proceedings, demands, fines, penalties, liabilities, costs and expenses (including, without limitation, reasonable attorneys’ fees and costs) (collectively, “Claims”) related to this Contest or the Crewfare Explorer Opportunity, including without limitation, Claims that may arise in connection with: (i) incomplete, lost, late, stolen, damaged, misdirected or illegible Entries or for failure to receive Entries due to any cause including, but not limited to, human, transmission, or technical problems, failures, or malfunctions of any kind, whether originating with sender, Released Parties or otherwise, that may limit an Applicant’s ability to participate in the Contest; (ii) acceptance, receipt, travel related to, participation in, delivery of, possession, defects in, use, non-use, misuse, inability to use, loss, damage, destruction, negligence or willful misconduct in connection with the use of the Explorer Perks (or any component thereof); (iii) any change in the Explorer Perks (or any components thereof) due to unavailability or due to reasons beyond Sponsor’s control; (iv) any incorrect or inaccurate information, whether caused by Applicant, printing or typographical errors or by any of the equipment or programming associated with or utilized in the Contest; (v) the violation of any third-party privacy, personal, publicity or proprietary rights, including third-party patent, copyright, or trademark rights; (vi) any interruptions in or postponement, cancellation or modification of the Contests or these Rules; (vii) any technical malfunctions or unavailability of any telephone network, computer system, online system, computer timing and/or dating mechanism, computer equipment, software or Internet service provider, or mail service utilized by any of the Released Parties or by an Applicant; (viii) any wrongful, negligent, or unauthorized act or omission on the part of any of the Released Parties; (ix) any injuries, losses, liabilities or damages of any kind including personal injury or death caused by the Crewfare Explorer Opportunity or resulting from acceptance, possession or use of any part of the Crewfare Explorer Opportunity or Explorer Perks including participation in any activity or travel related thereto, or from participation in the Contest or any of the Explorer Perks; or (x) any inability of the Winner to accept or use any of the Explorer Perks (or portion thereof) for any reason. Released Parties assume no responsibility for any damage to an Applicant’s computer system which is occasioned by accessing the websites of Released Parties or participating in the Contest, or for any computer system, phone line, mobile phone, hardware, software or program malfunctions, or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature, or for the incorrect or inaccurate capture of information, error in Entries or selection announcement, or the failure to capture any information. Released Parties will not be responsible or liable for any Entries in excess of the stated limit or for Entries that are late, forged, lost, misplaced, misdirected, tampered with, incomplete, deleted, damaged, garbled or otherwise not in compliance with the Rules, and all such Entries may, in Sponsor’s sole and absolute discretion, be disqualified. Applicant further agrees that Released Parties are in no matter responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the creation, administration or fulfillment of the Contest and/or the awarding of the Crewfare Explorer Opportunity . Released Parties will not be liable to Winner, or any other person for failure to supply the Crewfare Explorer Opportunity or any of the Explorer Perks or any part thereof, by reason of fire, flood, epidemic, earthquake, unusually severe weather, hurricane, embargo, explosion, labor dispute or strike, labor or material shortage, transportation interruption of any kind, work slow- down, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, any federal, state, or local government law, order, request, or regulation, or order of any court or jurisdiction, or any other cause beyond Released Parties’ control. The releases hereunder are intended to apply to all claims not known or suspected to exist with the intent of waiving the effect of laws requiring the intent to release future unknown claims. THE LIMITATIONS, EXCLUSIONS AND DISCLAIMERS IN THIS SECTION AND ELSEWHERE IN THESE RULES APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE APPLICABLE PORTIONS OF THESE RULES MAY NOT APPLY TO YOU.
- REPRESENTATIONS AND WARRANTIES. Each Applicant represents and warrants that he or she has read, understands and will follow these Rules. Applicants agree to indemnify and hold the Released Parties harmless from and against any third-party claim, to the extent arising out of or relating to any breach of any representation, warranty or covenant made by such Applicant in connection with his or her acceptance of these Rules or Contest activities.
- INDEMNIFICATION. Each Applicant shall indemnify, defend and hold harmless the Released Parties from and against any and all claims, damages, actions, liability, loss, injury or expense, including reasonable attorneys’ fees and costs, arising out of or in connection with: (a) Applicant’s participation in the Contest; (b) a breach or allegation which if true would constitute a breach of any of the representations, warranties or obligations herein; and (c) acceptance, possession, grant, or use of any of the Explorer Perks, including without limitation, personal injury, death and property damage arising therefrom.
- DISPUTES; CHOICE OF LAW. ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE RULES, OR THE RIGHTS AND OBLIGATIONS OF THE APPLICANT AND SPONSOR IN CONNECTION WITH THE CONTEST, SHALL BE GOVERNED BY, AND CONSTRUED IN ACCORDANCE WITH, THE LAWS OF THE STATE OF FLORIDA WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OR CONFLICT OF LAW RULES (WHETHER OF THE STATE OF FLORIDA OR ANY OTHER JURISDICTION), WHICH WOULD CAUSE THE APPLICATION OF THE LAWS OF ANY JURISDICTION OTHER THAN THE STATE OF FLORIDA. BY ENTERING THE CONTEST, APPLICANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE CONTEST, OR ANY AWARD AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED, (IF ANY), NOT TO EXCEED TWO HUNDRED FIFTY DOLLARS ($250.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; AND 3) EXCEPT WHERE PROHIBITED, UNDER NO CIRCUMSTANCES WILL ANY APPLICANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND APPLICANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. EXCEPT WHERE PROHIBITED, EACH PERSON WHO PARTICIPATES IN THE CONTEST IRREVOCABLY AGREES THAT SUCH DISPUTE(S) WILL BE RESOLVED SOLELY BY BINDING ARBITRATION BEFORE A SOLE ARBITRATOR, WITH EXPERIENCE IN ADVERTISING OR PROMOTION AND ENTERTAINMENT LAW, UNDER THE RULES AND REGULATIONS OF THE AMERICAN ARBITRATION ASSOCIATION (“AAA”); PROVIDED, HOWEVER, THAT NOTWITHSTANDING THE PARTIES’ DECISION TO RESOLVE ANY AND ALL DISPUTES ARISING UNDER THIS CONTEST THROUGH ARBITRATION, SPONSOR MAY (1) SEEK TO OBTAIN INJUNCTIVE RELIEF OR OTHER EQUITABLE RELIEF FROM A COURT TO ENFORCE THE PROVISIONS OF THESE RULES; (2) BRING AN ACTION IN COURT TO PROTECT AND INTERPRET SPONSORS INTELLECTUAL PROPERTY RIGHTS; AND/OR (3) BRING AN ACTION TO ENFORCE THE DECISION OF THE ARBITRATOR BEFORE ANY COURT WITH APPLICABLE JURISDICTION. THE ARBITRATION WILL BE HELD IN MIAMI-DADE, FLORIDA. THE ARBITRATOR WILL APPLY THE SUBSTANTIVE LAWS OF THE STATE OF FLORIDA, WILL ISSUE A WRITTEN DECISION AND WILL HAVE THE POWER TO AWARD ANY LEGAL REMEDIES EXCEPT AS LIMITED BY THESE RULES. The parties will split the arbitrator’s fee; provided, however, if applicable law requires Sponsor to pay the arbitrator’s fee in order for the arbitration provision to be enforceable, Sponsor shall have the discretion to pay such fees and proceed to arbitration. Applicant irrevocably waives any right to bring or join in any class action regarding the Contest. Judgment upon the arbitration award may be entered in any court having jurisdiction thereof. This arbitration provision shall be deemed to be self-executing, and in the event that any party fails to appear to any properly noticed arbitration proceeding, an award may be entered against such party notwithstanding said failure to appear.
- PRIVACY POLICY/DATA COLLECTION: Any personally identifiable information collected during an Applicant’s participation in the Contest will be collected by Sponsor or its designee(s) and used by Sponsor, its affiliates, designees, agents and marketers for purposes of the proper administration and fulfillment of the Contest as described in these Rules and in accordance with Sponsor’s Privacy Policy located at https://crewfare.com/privacy/. Each Applicant agrees to the collection, processing and storage of Applicant’s personal data by Sponsor for purposes of the Contest.

Requests must be received within thirty (30) days following the close of the end of the Voting Period (including any Run-off Voting Period).

- SEVERABILITY: If any portion of these Rules should be held invalid or unenforceable for any reason, such portion shall be deemed modified or severed from these Rules in such a manner as to enable the remaining portions of these Rules to remain in full force and effect as if no invalid or unenforceable provision had been part of these Rules.
Festival Entities, Lollapalooza®, and Austin City Limits Music Festival® are not sponsors of this Contest or the Crewfare Explorer Opportunity and are in no way responsible for the administration of this Contest or the Crewfare Explorer Opportunity, the selection or verification of winners, or the fulfillment of any prize.
